We are putting a business information pack together to raise capital and our question is do we need to get permission from our customers before we include their logo’s in the information pack?
Responses
Not sure if you can do this legally, but I would probably be a bit miffed if someone used my logo without talking to me about it first.
I would certainly be advising my clients about using their logo.

Hi Stuart
Great question. I’m not sure if there is a legal requirement that stipulates you have to get their permission but I think as a matter of courtesy it might be a good idea to let them know why and how you intend to use their logo’s.
I think it’s fair to say you shouldn’t mention or use the logo of any business unless they are actually a customer or client. If you are raising capital in the hope of doing business with a customer or in negotiations than I think you really do need to get speak to them and get their permission.
It is important to note that an information pack, pitch deck or information memorandum, whatever the term you want to use, must be accurate and a true reflection of the business opportunity. Future shareholders and legal representatives will not look too kindly on you if the information you present is in any way misleading.
All the best with the raise, I hope you kick some goals
Cheers
